Terms
The initial service term of the Agreement shall begin on the date that KandyanHost generates
an e-mail message to Customer announcing the activation of the Customer’s account (the
“Service Commencement Date”) and shall continue for one(1) year stated in the Order (the
“Initial Term”). Upon expiration of the Initial Term, this Agreement shall automatically renew
unless KandyanHost or Customer provides the other with written notice of non-renewal
through the customer center which is located at http://KandyanHost .com. The Initial Term and
any Renewal Term may be referred to collectively in this Agreement as the “Term.”
Payments
(a) Fees.
Fees are payable in advance on the first day of each billing cycle. Customer’s billing cycle
shall be annually as indicated on the Order, beginning on the Service Commencement Date.
KandyanHost accept only Cash or Cheque payments.
Payments must be made in Sri Lankan Rupees (LKR). Payee details indicate in order invoice.
Customer is responsible for providing KandyanHost with changes to billing information (such
as change in billing address) at its option
(b) Account/Service expire and renewal.
Kandyanhost will notify via email or phone call before your service expire. Your invoice is
generated 20 days prior to its expire date or due date. The due date is the day of the month
you signed up or order your service. YOUR MUST RENEW YOUR SERVICE ON OR BEFORE
THE DUE DATE.
(c) Grace Periods.
We will allow a 14 days grace period before assessing a late fee.
(d) Late Fees.
If an invoice is overdue by more than 14 days (the grace period), the account is automatically
suspended and a late fee is added to the account.
Late Fee Category
5000 LRK VPS and Dedicated Servers

To reactivate an account that is suspended for failure to submit a payment within the grace
period, a payment for the original invoiced amount plus account late fee must be
submitted to KandyanHost.
KANDYANHOST MAY SUSPEND THE SERVICE WITHOUT NOTICE IF PAYMENT FOR THE
SERVICE IS OVERDUE.
(e) Fee Increases.
KandyanHost may increase its fees for services effective the first day of a Renewal Term by
giving notice to Customer of the new fees at least 30 days prior to the beginning of the
Renewal Term.
Service fee will increase for following reasons.
1. Server Price change by Our Upstream provider (Datacenter) .
2. Changes of exchange rate.
3. For cover service cost of KandyanHost.

(f) Refunds and 7-Day Money Back Guarantee
Refunds or 7 day money- back guarantee does not apply to VPS Servers, Dedicated
Servers, Cloud Servers, Domain Registrations, Dedicated IPs, SSL Certificates or
any other services not listed here. Refunds are not available on account renewals.

Account Cancellation
All requests for canceling accounts must be made via info@kandyanhost.com with at least 14
days before the next invoice due date. You must have all account information to cancel and
accounts must be paid in full before the cancellation will be considered complete.
SPAM and Unsolicited Commercial Email (UCE)
KandyanHost takes a zero tolerance approach to the sending of Unsolicited Commercial Email
(UCE) or SPAM (of any kind) over our network.
Very simply this means that customers of KandyanHost may not use or permit others to use
our network to transact in UCE.
Customers of KandyanHost may not host, or permit hosting of, sites or information that is
advertised by UCE from other networks. Violations of this policy carry severe penalties,
including termination of service.

Violation of KandyanHost SPAM policy will result in severe penalties. Upon notification of an
alleged violation of our SPAM policy, KandyanHost will initiate an immediate investigation
(within 48 hours of notification). During the investigation, KandyanHost may restrict customer
access to the network to prevent further violations. If a customer is found to be in violation of
our SPAM policy, KandyanHost may, at its sole discretion, restrict, suspend or terminate
customer’s account.
ANY ACCOUNT FOUND VIOLATING THIS TERM MAY BE SUSPENDED OR TERMINATED
WITHOUT WARNING AND WILL CHARGE RE-ACTIVATION FEE of 50000 LKR.
SENDING UNSOLICITED BULK EMAIL (“UBE”, “UCE” , “SPAM”). THE SENDING OF ANY FORM OF
UNSOLICITED BULK EMAIL THROUGH KANDYANHOST’S SERVERS IS PROHIBITED.
PLEASE, DO NOT SPAM FROM YOUR ACCOUNT.
Back Up Copy
Your use of the Services is at your sole risk. KandyanHost is not responsible of any loss of data
or data corruption or hacking or accidental deletion. KandyanHost does not keep backup
records or backup copies of our clients.
Shared and Reseller Customers should maintain your backup copies in your cPanel.
VPS or Dedicated Customers should maintain your backup copies using extra drive
KANDYANHOST DOES NOT PROVIDE BACKUP SERVICE FOR FREE. IF YOU NEED
BACKUP DRIVE OR EXTRA DRIVE YOU HAVE TO PAY FOR IT.

Support Boundaries
KandyanHost provides 24/7 technical support to our subscribers. KandyanHost only ensures
that the server is online and is remotely accessible. KandyanHost does not offer tech
support for application specific issues such as cgi programming, html or any other such issue.
KandyanHost does not provide technical support for YOUR customers. If you can email, we
encourage you to email info@KandyanHost.com for assistance.

Acceptable Use Policy (“AUP”)

This Acceptable Use Policy (“AUP”) governs the use of KandyanHost’s web hosting service. Violation
of this AUP may result in suspension or termination of your service.

Offensive Content
• You may not publish or transmit via KandyanHost’s service any content that KandyanHost
reasonably believes:
• constitutes child pornography
• constitutes pornography or adult related material
• is excessively violent, incites violence, threatens violence, or contains harassing content or
hate speech
• is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain
letters and pyramid schemes
• is defamatory or violates a person’s privacy
• creates a risk to a person’s safety or health, creates a risk to public safety or health,
compromises national security, or interferes with a investigation by law enforcement
• improperly exposes trade secrets or other confidential or proprietary information of another
person
• is intended to assist others in defeating technical copyright protections
• clearly infringes on another person’s trade or service mark, patent, or other property right
• promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms
trafficking
• is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to
KandyanHost or
• is otherwise malicious, fraudulent, or may result in retaliation against KandyanHost by
offended viewers
• Content “published or transmitted” via KandyanHost’s service includes Web content, e-mail,
bulletin board postings, chat, and any other type of posting or transmission that relies on any
Internet service provided by KandyNHost.

Security
You must take reasonable security precautions. You may not provide free hosting services to
your clients. You must protect the confidentiality of your password, and you should change your
password periodically.
Abusive Actions
Any and all abusive actions directed towards our staff will not be tolerated. If you use foul language,
threaten us, or do anything else that we may find offensive, you will be subject to, at the Company’s
sole discretion, suspension or termination of Services without refund, with or without notice.
Restriction on Storage Space Usage
All accounts are subject to the following restrictions on storage space usage:
• Accounts must have valid, working websites, and not violate any previously subscribed terms
• All accounts Accounts are not for us of mass distribution of files, such as torrents or mirrors
ANY ACCOUNT FOUND VIOLATING THESE TERMS MAY BE SUSPENDED OR TERMINATED
WITHOUT WARNING AND NO REFOUND

Unsolicited E-Mail
You may not send any unsolicited e-mail, either in bulk or individually, to any person who has
indicated that they do not wish to receive it.
You must comply with the rules of any other network you access or participate in using your
KandynHost’s services.
Distribution of Viruses
Intentional distributions of software that attempts to and/or causes damage, harassment, or
annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in
the immediate termination of the offending account.
Material Protected by Copyright
You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other
work protected by copyright law unless:
• You have been expressly authorized by the owner of the copyright for the work to copy the
work in that manner
• You are otherwise permitted by established Sri Lanka copyright law to copy the work in that
manner.
KandynHost will terminate the service of repeat copyright infringes.

Copyright Infringement Notice
If you believe your copyright is being infringed by a person using the KandyanHost network, please
send your notice of copyright infringement to info @kandyanhost.com.
Your notice must include the following:
• A physical or electronic signature of a person authorized to act on behalf of the owner of an
exclusive right that is allegedly infringed
• Identification of the copyrighted work claimed to have been infringed, or if multiple
copyrighted words at a single site are covered by a single notification, a representative list of
such works at that site
• Identification of the material that is claimed to be infringing or to be the subject of infringing
activity and that is to be removed or access to which is to be disabled, and information
reasonably sufficient to permit KandyanHost to locate the material
• Information reasonably sufficient to permit Kandyanhost to contact you, such as an address,
telephone number, and, if available, an e-mail address
• A statement that you have a good faith belief that use of the material in the manner
complained of is not authorized by the copyright owner, the copyright owner’s agent, or the
law
• A statement that the information in the notification is accurate, and under penalty of perjury
that you are authorized to act on behalf of the owner of an exclusive right that is allegedly
infringed.

Service Level Agreement (SLA)

This Acceptable Use Policy (“AUP”) governs the use of KandyanHost’s web hosting

KandyanHost offers its clients a 100% network uptime guarantee for customer satisfaction purposes
and also to ensure that your business is running problem free. KandyanHost and Our (Datacenter)
Upstream Provider will try to maintain maximum uptime.
KandyanHost is not responsible for any downtime caused by the client.
KandyanHost is not responsible for outages or circumstances beyond our control that hinder access to
your site or server such as the following:
• Network conditions across the internet (outside of our network), such as between your ISP and our
data center
• DDoS or other attacks on our servers
• Problems with Your ISP’s network
• Browser or DNS caching issues
• Your Routing and firewall blocks/bans issues
Occasionally, servers and related hardware need to be brought down for routine maintenance, and
upgrades to ensure that our network is secure and performing optimally. We do our best to keep such
incidents to a minimum, and will attempt to give you advance notice of any scheduled maintenance.
These scheduled service outages do not qualify for the uptime guarantee.

Domain Names

You must have valid and current information on file with your domain name registrar for any domain
hosted on the Kandyanhost network.We do not provide our service for any free domain names or
extensions users.
Required Domain Registration Information
Registration information.
As part of the domain registration process and in accordance with ICANN policies, a Registered Name
Holder is required to submit, and update within seven (7) days of any change, complete and accurate
information, including the following (collectively, the “Registration Information”):
• The domain registrant’s name and postal address;
• The domain being requested;
• Administrative contact information, including the name, postal address, email address,
telephone number, and where available, fax number of the administrative contact for the
domain; and
• Technical contact information, including the name, postal address, email address, telephone
number, and where available, fax number of the technical contact for the domain; and
• Billing contact information, including the name, postal address, email address, voice
telephone number, and where available, fax number of the billing contact for the domain.
Additional registration information.
In addition, in accordance with ICANN policies, KandyanHost.com is obligated to submit and keep
current, complete and accurate additional information relating to a domain registration, which may
include the following (collectively, “Additional Registration Information”):
The original creation date of the domain registration;
The submission date and time of the registration to us and by us to the proper registry;
Communications (electronic or paper form) constituting registration orders, modifications, or
terminations and related correspondence between you and us;
Account records for your domain registration, including dates and amounts of all payments
The IP addresses of the primary nameserver and any secondary nameservers for the domain;
The corresponding names of those nameservers;
The name, postal address, email address, voice telephone number, and where available, fax number
of the technical contact for the domain;

The expiration date of the registration; and information regarding all other activity between you and
us regarding your domain registration and related services.
Transfer Domain from another registrar to KandyanHost
You can transfer any TLDs or CcTLDs domains from any other provider to Kandyanhost Network.
When Transferring domain name to Kandyanhost.com you should provide EPP (Domain Auth code )
to us.
Transfer Domain from KandyanHost to another registrar.
We have permit to transfer your domain name from Kandyanhost network to another domain
registrar.
The domain owner should request for transferring domain name via info@kandyanhost.com with at
least 7 days before the domain expire .After received the request, we will unlock and release the EPP
or Domain Auth code and allow to transferring.
Restrictions on transfer.
You agree that you may not transfer your domain registration to another domain registrar during the
first sixty (60) days from the effective date of your: (1) initial domain registration or (2) completion of
a domain transfer into Kandyanhost.com.
